Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the Thirstii mobile application and website at thirstiiapp.com (collectively, the “Service”), operated by Thirstii (“we,” “our,” or “us”).

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Material changes will be communicated via the app or email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

2. Age Requirement

YOU MUST BE 21 YEARS OF AGE OR OLDER TO USE THIRSTII.

Thirstii is a nightlife and bar discovery app for New York City. The venues featured — including bars, clubs, live music spaces, and other nightlife destinations — are intended for adults. By creating an account, you represent and warrant that you are at least 21 years old. We reserve the right to terminate accounts of users who misrepresent their age.

3. Accounts

3.1 Registration

To use Thirstii, you must create an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3.2 Username (Handle)

Upon registration, you will choose a unique username (handle). Handles are subject to availability and may not impersonate another person, use offensive language, or violate these Terms. We reserve the right to reclaim or reassign handles at our discretion.

3.3 Account Security

You agree to notify us immediately at contact@thirstiiapp.com if you suspect unauthorized access to your account. We are not liable for losses resulting from unauthorized use of your account.

3.4 One Account Per Person

You may not create multiple accounts. Duplicate accounts may be suspended or merged.

4. User-Generated Content

4.1 Your Content

Thirstii allows you to post ratings, scores, and tags (“User Content”). You retain ownership of your User Content. Tags you submit are contributed to anonymized aggregate counts per venue and are not linked to your account — they are not deleted upon account deletion.

4.2 License to Thirstii

By posting User Content, you grant Thirstii a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and modify your User Content in connection with operating and improving the Service. This license ends when you delete your content or account, subject to content already cached or distributed.

4.3 Public Visibility

Your ratings and scores are visible to friends. Non-friends can see up to 5 of your top and 5 most recent ratings unless your account is private, in which case no ratings are visible to non-friends. Do not post content you do not wish to be publicly visible.

4.4 Content Standards

You agree not to post User Content that:

We reserve the right to remove any User Content that violates these standards, at our sole discretion, without notice.

5. Social Features

5.1 Following

You may follow other users to see their ratings and activity in your feed. Following a user does not imply endorsement of their views or content.

5.2 Friend Discovery

With your permission, Thirstii may access your device contacts to suggest friends who are already on the platform. This feature is optional and can be disabled in your device settings.

5.3 Notifications

Thirstii sends notifications when other users interact with your content. You can manage notification preferences in your device's Settings app.

6. Venue Information

Bar and restaurant information on Thirstii is sourced from Google Places API and user-submitted ratings. We do not own or operate any venues listed on the platform. Venue details including hours, addresses, and photos may not always be accurate or up to date. Always verify venue information directly with the establishment before visiting.

7. Alcohol and Responsible Drinking

Thirstii is a nightlife discovery and social platform — we do not sell, serve, or deliver alcohol.

9. Intellectual Property

9.1 Our Property

The Thirstii name, logo, app design, code, and all non-user content are owned by Thirstii and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our proprietary content without our express written permission.

9.2 Feedback

If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without restriction or compensation to you.

10. Third-Party Services

The Service integrates with third-party services including Google Places API. Your use of these services may be subject to their own terms and privacy policies. Thirstii is not responsible for the content, accuracy, or practices of third-party services.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that:

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIRSTII AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO: LOSS OF DATA; PERSONAL INJURY OR HARM RESULTING FROM ALCOHOL CONSUMPTION; RELIANCE ON VENUE INFORMATION OR USER REVIEWS; UNAUTHORIZED ACCESS TO YOUR ACCOUNT; OR ANY CONDUCT OR CONTENT OF THIRD PARTIES ON THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Thirstii and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

14. Termination

14.1 By You

You may delete your account at any time directly within the app by going to Settings → Delete Account. Deletion is permanent and cannot be undone. You may also contact us at contact@thirstiiapp.com for assistance.

14.2 By Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

14.3 Effect of Termination

Sections 4.2, 9, 11, 12, and 13 survive termination of these Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property disputes.

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
